General Terms & Conditions
1. Eligibility & Agreement
Age: Clients must be of legal age or have permission from a legal guardian.Agreement: Submitting an inquiry means you voluntarily agree to all terms listed here.2. Usage & Licensing
Default License: All commissions are for Personal, Non-Commercial Use only (social media profiles, personal prints, etc.).Commercial Use: Any profit-generating use must be discussed and licensed separately before work begins.3. Deliverables & Privacy
Format: Digital files only (full-res .PNG). No physical products will be shipped.Public Display: The Artist reserves the right to post the artwork (with a watermark) on social media/portfolios. If you need a specific release date or a Private Commission, please discuss it upfront.4. Rights of Refusal & Cancellations
Right to Decline: The Artist reserves the right to reject any request for any reason.Refund Deadline: 100% refunds are only available before the project status changes to "Coloring". No refunds after the final file is delivered.5. Strict Prohibitions
The Client is strictly PROHIBITED from:Tracing, editing, or altering the artwork without permission.Removing or obscuring the Artist's watermark/credit.Using the artwork for NFTs, cryptocurrency, or AI generation/training. (Violation results in an immediate blacklist).6. Copyright & Intellectual Property
Artwork: Intellectual property and copyright of the artwork belong strictly to the Artist (miichiyochin).Characters: Rights to original characters (OCs) or official fanart characters belong entirely to their respective owners.
Commercial Usage applies whenever the Client intends to generate profit from the artwork.1. Licensing & Ownership
The License: You purchase the right to use the artwork for your project. However, intellectual property and creation rights remain strictly with the Artist. You cannot claim to be the creator.Specifications: All project details (dimensions, formats, exact usage) must be provided upfront during the inquiry.Priority: Commercial orders have a higher priority than personal ones (Rush > Commercial > Personal).2. Commercial Fee Structure
Commercial fees are calculated as a multiplier of the base price:2x Base Price (Digital-Only): For digital products (streaming assets, game CGs, digital banners).3x Base Price (Physical / Mixed / Branding): For physical merchandise, vtuber models, agency/corporate projects, or a mix of both digital and physical items.* Note: If your needs change, you can purchase commercial rights retroactively after the commission is completed.3. Credit & Restrictions
Credit & Watermark: Credit is mandatory. Watermarks may be adjusted or removed for specific commercial assets, provided clear credit is given in the project description.AI & NFT Ban (Strict): The artwork cannot be used for NFTs, cryptocurrency, or as training data for Generative AI. Violating this will result in an immediate blacklist and loss of usage rights.Large Projects: For extensive projects, please email your full brief to [email protected].
Private commissions ensure the completed artwork will not be posted on the Artist's public social media accounts. The Artist reserves the right to use the work strictly within their professional portfolio.1. Queue VisibilityPrivate and Commercial commissions will be marked as "Anonymous" on the production queue, but the commission type will remain public in the waitlist here.2. Client DisclosureIf the Client chooses to share their commission publicly, the Artist reserves the right to subsequently share the artwork on their own social media channels.3. Portfolio ExemptionIf the Client explicitly requests that the artwork not be posted online at all (including the portfolio), they must notify the Artist so that appropriate accommodations can be negotiated.
Payment & Refund Policy
1. Pricing & Payment Methods
Quotes: Inquiries and price estimates are non-binding and do not commit you to a purchase.Currency & Methods: Payments are accepted via PayPal (USD). For other payment options, please DM to discuss.2. Invoicing & Deadlines
Upfront Payment: Work begins only after full payment is received (unless a payment plan is approved).Invoice Due Date: Invoices are sent after details are finalized. You have 3 days to pay. If you experience delays, please communicate early.3. Payment Plans (For orders over $500 USD)
Eligibility: Orders over $500 USD are eligible for a 50/50 split payment plan (must be pre-approved before invoicing).Final Delivery: The final high-res file will only be delivered after the balance is paid in full. You will receive a low-res, watermarked preview once the art is finished.4. Refunds & Chargebacks
Full Refund Deadline: You can get a full refund before the project status changes to "Coloring" in the queue.Partial/No Refund: Once coloring begins, only a partial refund is possible. No refunds are given after the final artwork has been delivered.Artist-Initiated Refunds: A 100% refund will be issued if the Artist has to cancel due to emergencies or mutual agreement.Chargeback Policy: Unauthorized chargebacks after delivery will result in an immediate blacklist, loss of all usage rights to the artwork, and a public warning to other artists.
Commission Workflow & Policy
1. Preparation
References: Clients must provide visual references (mood boards, anime/manga, VNs, etc.).
Text-only: Commissions based solely on text descriptions are not accepted.2. Submission & Communication
Inquiry: Submit your brief via DM or Email. A detailed brief saves time for both parties.
Stay Connected: The Artist will stay in touch to resolve any issues; please ensure you are reachable.3. Review & Waitlist
Queue: If accepted, you will be added to the queue via Waitlist/Carrd. Don't hesitate to communicate with me via X/bsky.
Channels: All further discussions and updates will be conducted exclusively via DM or Email.4. Turnaround & Priority
Priority Order: Rush > Commercial > Personal (based on submission date).Timeline: Estimated completion is 2 weeks to 1 month. A specific ETA will be provided only after details are confirmed and full payment is received.Delays: Timelines may extend due to queue length, art complexity, or health/personal reasons. You will be notified when your slot moves to "Sketching".5. Deliverables & Storage
Format: Digital files only (.PNG) delivered via email/DM. No physical prints.Storage: Google Drive links will be cleared every 3 months. Please download and backup your files immediately. The Artist is not responsible for file loss after delivery.Artist Cancellation: If the Artist cannot fulfill the request, the project will be canceled and a 100% refund issued.6. WIPs, Revisions & Restrictions
WIP Shares: WIPs are sent after payment (upon request or for clarity). Public sharing of WIPs is allowed, except for Private/Commercial projects.Revisions: Maximum of 4 free WIP reviews for minor corrections (small colors, missing accessories). Major changes (outfits, poses, backgrounds) will incur an hourly fee.Final Cancellation: If you remain unsatisfied after all revisions, the commission will be canceled and fully refunded.WIP Rights & AI Ban: Clients hold no rights to WIPs (especially for canceled projects). Using WIPs for AI generation or NFTs is strictly prohibited and will result in an immediate blacklist.
1. Client Rights
Personal Use: Display the artwork on non-profit websites/social media, and use it for personal purposes (e.g., wallpapers, icons, gifts, or printing for personal use).
Commercial Use: Sell the artwork as digital goods or merchandise only after purchasing the commercial usage license and agreeing on terms with the Artist.
Character Ownership: Retain full rights to your original character(s). However, ownership of the artwork itself and its creation rights belong strictly to the Artist.
Credit Requirement: Publicly post the artwork online or offline, provided you give proper credit to the Artist (chiyo / @miichiyochin) by tagging or linking back to their social media/website.
2. Artist Retained Rights
The Artist (miichiyochin) retains all rights to the copyrighted artwork and is permitted to:
Self-Promotion: Display the artwork (with a watermark) in portfolios, commission websites, and across any social media or online platforms.
Publication: Publish the artwork in advertisements, promotional materials, books, or other publications.
Process Media: Create and share timelapse or progress videos of the artwork (unless a privacy agreement has been made with the Client).
3. Copyright Infringement and Violations
The following actions are considered material violations of this agreement:
Unauthorized Reproduction: Reproducing, distributing, tracing, editing, selling, and/or utilizing the copyrighted artwork commercially without the explicit consent of the Artist (i.e., generating profit without prior commercial agreement).
Failure to Credit: Failing to provide proper credit when publicly reposting the artwork (e.g., omitting the website link, social media tag, or proper untagged reference).
Tampering: Removing any watermarks or signatures from WIPs or completed illustrations.
Unauthorized Modification: Altering or modifying the artwork without the Artist's express written consent.
Misuse of Purpose: Using the completed commission outside of its intended and agreed-upon usage (e.g., using a personal-use commission for commercial purposes).
Blockchain/AI Usage: Utilizing any of the Artist’s illustrations in any blockchain-related technology, including NFTs, cryptocurrency, AI-generation, or future inventions within those spaces.
Consequences of Infringement
Any instance of the Commissioner breaking the Copyright Infringement policy will result in the immediate retraction of all usage rights granted to the Client for the commission. The Client will be blacklisted, and a warning will be formally issued to potential vendors.
