1. Client Eligibility and AccountabilityLegal Standing: The Client must be of legal age (as defined by their jurisdiction) or possess express written consent from a legal guardian to purchase the commission.Voluntary Agreement: By submitting an inquiry, the Client acknowledges that the commission is a voluntary transaction and agrees to abide by these Terms.2. Usage Rights and LicensingPersonal Use License: All commissioned artwork is provided solely for Personal, Non-Commercial Usage (e.g., private display, personal social media).Commercial Use: Any form of Commercial Usage (including, but not limited to, merchandise, promotion, or profit-generation) must be explicitly discussed, agreed upon, and licensed by both the Artist and the Client prior to the commencement of the commission.3. Deliverables and Digital File PolicyDigital Goods Only: The client is purchasing a digital file only. No physical goods or hard copies will be processed or delivered.Final File Specifications:* The client will receive the full-resolution illustration as a PNG file. This file will include a small, permanent watermark applied by the Artist.Watermark Integrity: The removal of the Artist’s watermark is strictly prohibited.4. Display and Publication PolicyPublic Display: All commissioned artwork is considered public by default. The Artist reserves the right to publish the final work on social media and portfolio channels.

Artist's Right to Refusal and DiscretionThe Artist, miichiyochin, reserves the absolute right to reject any commission request for any reason without explanation.Should the Artist determine that they cannot complete the requested work to a satisfactory professional standard, the commission will be promptly declined.6. Refund and Cancellation PolicyRefund Eligibility: Refunds are issued exclusively during the commission process and are not available after the completed artwork has been delivered.Full Refund Cut-Off: A request for a full refund is only eligible before the project status is marked as "Coloring" in the production queue. Once the "Coloring" tag is applied, the commission is considered in its final stages and is no longer eligible for a full refund.7. Prohibited Actions by the ClientThe Client is strictly prohibited from engaging in the following actions with the purchased artwork:Tracing, Editing, or Altering the artwork without prior written consent.Reposting or Selling the artwork outside of the terms agreed upon.Rendering the artwork in any manner not explicitly discussed during the commission process.Removing or Obscuring the Artist’s watermark or credit.8. Exclusion of NFT/Blockchain TechnologyIt is explicitly states that I, the Artist have no interest in, association with, or endorsement of Non-Fungible Tokens (NFTs), blockchain-related technology, cryptocurrency, AI-generated projects, or future related inventions. The Client is strictly prohibited from utilizing the commissioned artwork for any of these purposes.9. Intellectual Property and RightsArtist Rights: The Artist, miichiyochin, maintains all rights to the intellectual property of the original artwork created for the commission.Client/IP Rights: The Artist does not maintain the rights to any character owned by the Client or derived from established intellectual properties (IPs). Characters and relevant concepts used in fanwork belong to their respective owners. All other rights are reserved by the Artist.
Commercial usage is defined as any scenario where the Client intends to generate any form of profit from the completed artwork.1. Commercial Commission Terms1.1. Licensing and OwnershipRights Purchase: The Client purchases the license rights to utilize the artwork within their product or project scope, as defined below (1.4).Ownership Claim: The Client cannot claim ownership of the artwork itself (i.e., claiming to be the illustrator or original creator), even with the purchase of full commercial rights. All original intellectual property rights to the artwork remain with the Artist.1.2. Project SpecificationsThe Client must explicitly detail the intended use of the artwork and provide all necessary project specifications (e.g., precise dimensions, project type, required file formats, etc.) at the time of inquiry.1.3. Prioritization and TimelineCommercial commissions receive higher priority than Personal commissions. They are subject to a priority queue structure (Rush > Commercial > Personal) and do not adhere to the standard Personal commission waiting time.1.4. Scope of Commercial UsageCommercial usage includes, but is not limited to, the use of the artwork for: account banners for revenue-generating channels, streaming assets, game assets (e.g., title screens, CGs, character portraits), promotional work, designs for tangible merchandise (stickers, charms, prints), Live2D models, or any application where the artwork constitutes a majority of the product’s presentation.1.5. Commercial Fee StructureCommercial fees are applied as a multiplier to the base commission price.Digital-Only Goods (2x Fee): Applies to digital products intended for commercial release.Physical Merchandise (3x Fee): Applies to products intended for physical reproduction (e.g., printing, manufacturing).Mixed Use (3x Fee): If the commission involves both digital and physical merchandise, the 3x Commercial Fee will be applied across the entire project.Agencies/Branding (3x Fee): All commissions for agencies, businesses, or products used as part of a formal brand identity (e.g., VTuber models) require the 3x Commercial Rights Fee.1.6. Retrospective Rights PurchaseThe Clients may purchase the required commercial rights (for digital goods or merchandise) retroactively, should their usage needs change after the commission has been completed.1.7. Extended Project ConsultationFor extensive projects requiring detailed specifications, the Client is advised to submit a full project description via email to: [email protected].2. Artwork Credit and Usage Restrictions2.1. Credit and Watermark PolicyThe exclusion of both the Artist's credit and the watermark is non-negotiable.Accommodations regarding watermark placement or visibility may be made for specific commercial projects (e.g., no visible watermark on the final asset, provided explicit credit is given in a prominent description).2.2. Strict Exclusion: Blockchain and AIThe Client does NOT retain the right to use the artwork in any blockchain-related technology, including NFTs, cryptocurrency, AI-generation, or any future inventions within those spaces. This restriction also encompasses the intention to use the artwork as a source or base for Generative AI training or future NFT generation.Failure to comply with this exclusion will result in immediate blacklisting.
Private commissions ensure the completed artwork will not be posted on the Artist's public social media accounts. The Artist reserves the right to use the work strictly within their professional portfolio.1. Queue VisibilityPrivate and Commercial commissions will be marked as "Anonymous" on the production queue, but the commission type will remain public in the waitlist here.2. Client DisclosureIf the Client chooses to share their commission publicly, the Artist reserves the right to subsequently share the artwork on their own social media channels.3. Portfolio ExemptionIf the Client explicitly requests that the artwork not be posted online at all (including the portfolio), they must notify the Artist so that appropriate accommodations can be negotiated.
1. Commission Quotation and Initial InquiryNon-Binding Quotes: Inquiring about a project quote or discussing potential pricing does not constitute a commitment or binding agreement to purchase the commission.Pre-Inquiry Pricing: Clients who are unsure of the potential cost of their project are strongly encouraged to request a preliminary estimate before submitting a formal commission inquiry.2. Accepted Payment MethodsPayments are accepted exclusively via PayPal, denominated in U.S. Dollars (USD).For other options, DM me to disscuss.3. Invoicing and Commencement of WorkFull Payment Required: Work will only commence upon the Artist’s confirmed receipt of the full payment amount, unless a payment plan is explicitly approved (see Section 4).Invoice Issuance: A formal invoice will be dispatched to the Client after all commission details, specifications, additional fees, and necessary reference materials have been finalized and confirmed.Payment Grace Period: Clients are granted a three-day grace period to complete payment upon receipt of the invoice. Accommodations for payment processing delays may be arranged only if the Client establishes clear and timely communication regarding the issue.4. Payment Plans (Commissions Over $500 USD)Eligibility: Commissions totaling over $500 USD are eligible for a structured payment plan, which include a half-upfront deposit option.Pre-Approval Required: Any deviation from the full upfront payment requirement must be formally discussed and approved by the Artist before the final invoice is issued. Failure to secure pre-approval mandates full upfront payment.Final Deliverable Hold: For commissions utilizing a payment plan, the final, high-resolution completed file will be delivered only upon the Artist’s receipt of the final outstanding payment. A low-resolution, watermarked proof image will be provided upon completion to assure the Client of the finished product.5. Refunds and Chargebacks5.1. Refund Eligibility*Refunds are exclusively processed during the commission process. No refund is possible after the final product has been completed and formally delivered to the Client.Full Refund Cut-Off: The deadline for a full refund is strictly set before the project status is changed to Coloring in the production queue. Once the Coloring status is applied, the commission is considered near-finalized, and only a partial refund can be considered.5.2. Artist-Initiated RefundsIn certain circumstances or emergencies (including, but not limited to, artist incapacity, critical client disapproval, or mutual cancellation due to unforeseen financial issues), a full refund may be issued regardless of the phase of completion.5.3. Consequences of Unauthorized ChargebacksShould a chargeback be filed after the commissioned artwork has been fully completed and delivered, the Client's rights to all previously acquired artwork created by the Artist will be immediately retracted.The Client will be permanently blacklisted from commissioning the Artist in the future, and a formal warning will be distributed to other potential vendors.The Artist reserves the unconditional right to file an official complaint or report to pursue compensation for the rendered work, as necessary.
1. Preparation of Reference MaterialsPrior to submission, clients are required to gather and compile all necessary reference materials and resources. Acceptable references include, but are not limited to, examples sourced from anime, manga, mood boards, light novels (LNs), and visual novels (VNs).Note: Commissions based solely on text descriptions without visual reference aids are not accepted to ensure accurate artistic interpretation and execution.2. Submission of InquiryInquiries can be submitted after/during disscussion through DM/email. You can prepare a brief document for time-saving. The more detailed the brief is, the more easy for both of us to work with. Artist will personally keep in touch with client to resolve any problems prossible. So please, keep in touch.3. Review and Waitlist AssignmentFollowing the submission review:Acceptance: If the commission request is accepted, the client will be formally placed onto the Artist's waiting list, which is managed through Queue.Communication: All subsequent project discussions, clarifications, and documentation will be conducted exclusively through email/DM.4. Commission Turnaround and PrioritizationQueue Management: Commissions are processed sequentially based on the date of inquiry receipt and the project type. The established order of priority is Rush > Commercial > Personal.Estimated Turnaround: The estimated commission completion time ranges from two (2) weeks to one (1) month. A specific Estimated Time of Arrival (ETA) will be provided only after the commission details are confirmed and full payment has been successfully received.Timeline Factors: Clients acknowledge that completion timelines may be extended due to the length of the existing queue and external factors, including the Artist’s health, personal commitments, and the overall complexity of the commissioned work.Work Commencement Notification: Clients will be formally notified via Email when the production of their commission begins, at which point the project slot will be moved to the "Sketching" in the queue.5. Deliverables and File IntegrityDigital Delivery: The finished commission will be provided as a watermarked digital file (.PNG) delivered via email/DM. No physical copy of the completed artwork will be provided.Loss of Product: The Artist is not responsible for the loss or corruption of the digital product once confirmation of delivery to the Client has been established. Google drive will be cleaned once per 3 months, so please save your commission as soon as possible and put it in your personal drive.Artist-Initiated Cancellation: Should the Artist determine that they cannot fulfill the commission request for any reason, the project will be canceled, and a full refund will be immediately issued to the Client.6. Work-In-Progress (WIPs), Errors, and RevisionsWIP Provision: WIPs are provided to the Client only after payment has been received. They can be requested by the Client or issued by the Artist for necessary clarification of project details.Public Display of WIPs: WIPs may be posted publicly by the Artist, with the exception of Private and Commercial commission projects.Revision Limits: The Client is permitted a maximum of four (4) WIPs for review. This limit may be extended by the Artist if deemed necessary, but it serves as the standard constraint for most commissions.Minor Corrections: Minor mistakes (e.g., small color adjustments, missing accessories, minimal background elements) will be corrected free of charge.Major Changes: Significant alterations (e.g., substantial changes to entire outfits, poses, full background design, or large-scale color shifts) will incur an hourly revision fee based on the time required to implement the modifications.Final Cancellation: If, after all revisions and negotiations are complete, the Client remains fundamentally unsatisfied, the commission will be canceled, and a full refund will be provided.WIP Ownership: The Client does not retain any rights to WIPs created during any stage of progress, including those created for canceled projects.WIP Usage Restriction: WIPs are strictly prohibited from being used for any projects involving AI-generation or NFTs. Proven misuse of WIPs for these purposes will result in an immediate blacklist and a warning disseminated to potential vendors.
1. Permitted Client UsageThe Client is expressly authorized to:
Utilize the final artwork for its intended purpose (as defined under the Commercial or Personal Usage terms).
Display the artwork on non-profit websites and social media platforms (e.g., X/Twitter, Instagram).
Employ the artwork for personal, non-distributive uses (e.g., digital wallpaper, profile pictures/icons, or as gifts).
Sell the artwork for digital goods and/or merchandise only after purchasing the corresponding commercial usage fees.
Print the artwork for personal use, but not sell them as prints unless specific commercial rights have been purchased and agreed upon.
Claim the rights to their original character(s), but not the ownership of the artwork itself or the act of its creation.
Publicly post the artwork online or offline, provided proper credit is given to the Artist, chiyo (@miichiyochin), via linking the Artist’s website, tagging social media accounts, and/or providing an untagged credit reference.
2. Artist Retained RightsThe Artist (miichiyochin) retains all rights to the copyrighted artwork and is permitted to:
Utilize the copyrighted artwork for self-promotion (e.g., portfolio with watermark, commission website display).
Publish the artwork in advertisements, promotional materials, books, or other publications.
Create and publish timelapse or progress videos of the artwork, unless an agreement for privacy reasons has been established.
Display the artwork across any preferred platform (e.g., social media, online profiles).
3. Copyright Infringement and ViolationsThe following actions are considered material violations of this agreement:
Unauthorized Reproduction: Reproducing, distributing, tracing, editing, selling, and/or utilizing the copyrighted artwork commercially without the explicit consent of the Artist (i.e., generating profit without prior commercial agreement).
Failure to Credit: Failing to provide proper credit when publicly reposting the artwork (e.g., omitting the website link, social media tag, or proper untagged reference).
Tampering: Removing any watermarks or signatures from WIPs or completed illustrations.
Unauthorized Modification: Altering or modifying the artwork without the Artist's express written consent.
Misuse of Purpose: Using the completed commission outside of its intended and agreed-upon usage (e.g., using a personal-use commission for commercial purposes).
Blockchain/AI Usage: Utilizing any of the Artist’s illustrations in any blockchain-related technology, including NFTs, cryptocurrency, AI-generation, or future inventions within those spaces.
Consequences of Infringement
Any instance of the Commissioner breaking the Copyright Infringement policy will result in the immediate retraction of all usage rights granted to the Client for the commission. The Client will be blacklisted, and a warning will be formally issued to potential vendors.
